EMCC: HR Forum – Migration Advisory Committee roundtable and employment law update

Employment law doesn’t stay the same for long.  Indeed, for most businesses or organisations, employment issues sit firmly at the top of the list. Undoubtedly, the pressure on employers to keep up with endless regulation is great.  Moreover, many do not appreciate the legal consequences of failure to comply.

What’s on offer?

Hosted by Chamber Strategic Partner, Geldards LLP, we will hear from Rhys Wyborn, Partner, Geldards LLP.  Rhys will provide delegates with an employment law update, looking at notable changes for 2019.  Of course, this will include the potential impact of Brexit.

We will then undertake a roundtable discussion, led by Tracey Liennard, Migration Advisory Committee (MAC).  This discussion will be around reviewing the Shortage Occupation List (SOL).

Why the SOL is important

The Shortage Occupation List identifies skilled roles deemed to be in critically low supply in the UK labour market.  Where employers want to fill roles featured on the SOL, the rules on hiring non-UK and non-EEA employees under the Tier 2 (General) visa are relaxed:

  • Shortage occupation roles are exempt from the stringent requirements under the Resident Labour Market Test. This is extremely advantageous for the recruiting employer in both administrative and cost terms when hiring Tier 2 migrants.
  • Shortage occupation roles attract priority over non-SOL roles where the cap on Certificates of Sponsorship has been reached in any given month.  In fact, this was the case for consecutive months after November last year.

In June 2018, the government commissioned the MAC to carry out a full review of the composition of the shortage occupation list (SOL).  With the report due in spring 2019.  As part of the review, which began in the autumn, the MAC is looking to hear from employers and to identify the sort of information that they will find most helpful to ensure that the SOL meets the needs of UK employers.

Finally there will be an option to stay for a discussion, led by Thalej Vasishta, Group Chief Executive Officer of Paragon Law.  This discussion will be around how regional employers can work together to gain access to seasonal and low skilled staff through the Tier 5 Government Authorised Exchange visa route.
